Time Limits for Filing a Probate Proceeding

Statutes of Limitation

A statute of limitations sets a limit of the maximum amount of time after a wrong occurs in which a person harmed by that wrong may file a lawsuit. Each state sets its own limitations periods and these periods are often different for different kinds of cases. The limitations periods for filing a probate proceeding are as follows.

In Connecticut, probate proceedings must be brought within ten years of the decedent’s death, but a court may allow a late proceeding on a showing of good cause or if there is property of the deceased discovered after the ten year period has elapsed. In addition, when any minor is interested, one year shall be allowed after the minor attains the age of majority to take out administration or to cause such will to be proved.
