Privacy Protections on Probate Cases
Michigan allows for public access to guardianship hearings, and courts can make available reports by a physician or mental health professional.
Unless requested by the protected party or their counsel, the issue of incapacity will be determined in an open hearing with a jury.
Court-ordered reports by a physician or mental health professional are not public, but shall be available to the alleged incapacitated individual, to the petitioner, to their respective legal counsels, and to other persons as the court directs.
