Privacy Protections on Probate Cases

Minnesota allows for public access to confidential information in the bill of particulars through consent or a court order. Guardianship hearings are open unless requested to be closed, and any person can request to participate in them.

Confidential information in a bill of particulars will be available to a person if he or she obtains consent from the parties or their attorneys, or if that person gets a court order for good cause shown.

The guardianship hearing may be closed upon the request of the respondent and a showing of good cause.

The court may allow any person to participate in the guardianship proceeding upon a showing of good cause and if the best interest of the respondent will be served.
