Probate Code
Guardians and conservators (aka guardians of the estate) are generally entitled to reasonable compensation for their work. State statutes limit the fees to a certain amount which cannot be exceeded without prior court approval. Others just permit reasonable compensation and allow courts to interpret what constitutes excessive compensation.
Except in unusual circumstances, the guardian is entitled to the same compensation and reimbursement for actual and necessary expenses as the trustee of a trust.
No petition or hearing is required to entitle the guardian to compensation and expenses. However, on the petition of any interested person and on a finding by the court that unusual circumstances exist, the court may increase or decrease compensation.
