Probate Code
Guardians and conservators (aka guardians of the estate) are generally entitled to reasonable compensation for their work. State statutes limit the fees to a certain amount which cannot be exceeded without prior court approval. Others just permit reasonable compensation and allow courts to interpret what constitutes excessive compensation.
The guardian may at any time apply by motion to the Probate Division of the Superior Court for payment of fees or reimbursement of expenses incurred as a result of the guardianship.
The court may grant the motion and approve payment if it finds the expenses were reasonable and supported by documentary evidence. The guardian will not be paid any fees to which he or she may be entitled or reimbursed for any of his or her expenses until the annual reports have been filed.
