Medicare-Medicaid Pay-Down of Assets
State law and regulations impose income and asset limits on persons applying for Medicaid.
The income limit for the institutional Medicaid program and certain home and community-based waiver programs is determined by the Wyoming Department of Health and is set at 300% of the Federal Benefit Rate. For 2025, the Medicaid income limit for individuals eligible is $2,901 per month.
To be eligible for Medicaid, an individual may not have assets in excess of $2,000 as of the first day of the month. A married couple, when both are applicants, may not have assets in excess of $3,000; if only one spouse applies, the non-applicant spouse may retain up to $157,920 in assets.
The look-back period for transfers is 60 months from when the person first applied for Medicaid.
The penalty period beings the first month an applicant is otherwise Medicaid eligible or a month after WDH is notified and a client has transferred a resource while eligible.
The penalty period is the number of months and days determined by dividing the uncompensated value by the average private pay rate of $7,936 (adjusted periodically for inflation).
