Privacy Protections on Probate Cases

Kentucky protects the records of the protected person throughout the proceedings, and may expunge the file for cause.

Records of the protected person throughout the proceedings are labeled as confidential, but can be accessed via a showing that the disclosure is appropriate and in the best interest of the person or the public.

If the protected person is determined to no longer be disabled or the petition has been withdrawn or dismissed, the protected person can file a motion to expunge the records, provided that the person submits a full release of all claims arising from the proceeding.
