Privacy Protections on Probate Cases

The existence of a guardianship or a guardianship proceeding for an adult is generally a public record, and confidential information can be obtained through a court order.

As of January 1, 2023, the existence of a proceeding for, or the existence of a guardianship for, an adult is a matter of public record unless the court seals the records after the protected person requests they be sealed and either the petition for guardianship is dismissed or the guardianship is terminated.

A court shall grant access to court records of the guardianship, including an annual report or guardian's plan, if a person shows good cause and granting access is in the best interest of the protected person or furthers the public interest, does not endanger the adult's welfare or financial interest.
